Please read these Terms of Service (the "Terms") carefully before using the Proxliner application (the "Service") operated by Proxliner (referred to as "us", "we", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
The Service is a Software-as-a-Service platform utilizing the Stackpost framework, designed to help users manage, schedule, and automate content posting across multiple social media platforms including Google, Facebook, Instagram, and TikTok (the "Third-Party Platforms").
Eligibility: You must be at least 18 years old to use the Service.
Account Responsibility: You are responsible for safeguarding the password and credentials that you use to access the Service and for any activities or actions under your account. You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Third-Party Platforms: By connecting Third-Party Platform accounts (Google, Facebook, Instagram, TikTok, etc.) to the Service, you represent that you have the full authority to grant us access to those accounts. You understand and agree that the Service acts merely as a tool and must comply with the terms and policies of each Third-Party Platform.
Ownership: All data, text, files, links, software, photographs, videos, sounds, or other materials ($\text{"User Content"}$) that you create, post, or display via the Service remain your sole responsibility and property.
License to Us: By posting $\text{User Content}$ through the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and publish that content only as necessary to provide the Service (i.e., scheduling and publishing the content to your designated social media accounts). This license terminates when you delete your content or account.
Content Compliance: You are solely responsible for ensuring that all $\text{User Content}$ you post complies with all laws and the terms and policies of the respective Third-Party Platforms.
You agree not to use the Service:
For any unlawful purpose or to promote illegal activities.
To post content that is harassing, defamatory, vulgar, or obscene.
To violate the intellectual property rights or the terms of service of any Third-Party Platform (especially those of Google, Facebook, Instagram, and TikTok).
To upload or transmit viruses, or any other type of malicious code.
To attempt to gain unauthorized access to our Service or any system connected to it.
Subscription: If the Service is provided on a subscription basis, you will be billed in advance on a recurring, periodic basis.
Changes: We reserve the right to change the subscription fees or introduce new fees upon prior notice.
No Refunds: Unless expressly stated otherwise, all fees are non-refundable.
The Service and its original content (excluding $\text{User Content}$), features, and functionality are and will remain the exclusive property of [Your Company Name] and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without 1the prior written consent of [Your Company Name].
We may terminate or suspend your account immediately, without prior notice or liability, if you breach the Terms, particularly if you violate the policies of the Third-Party Platforms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
Disclaimer: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no guarantee that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
Third-Party Risk: You acknowledge that we are not responsible for any changes, suspensions, or termination of your accounts on Third-Party Platforms (Google, Facebook, Instagram, TikTok, etc.) due to your use of the Service or your failure to comply with their respective terms.
Limitation of Liability: In no event shall Proxliner, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.
These Terms shall be governed and construed in accordance with the laws of Indonesia, without regard to its conflict of law provisions.
